Radventurers Mobility Technology Demonstration, Pilot, Tour, Rental, or Experience Participant Agreement

This agreement is between the participant identified above (“Participant”) and Radventurers CO LLC, including its owners, officers, employees, contractors, volunteers, affiliates, property owners, technology manufacturers, distributors, sponsors, and agents, to the extent permitted by law (collectively, “Released Parties”).

1. Nature of the activity

I understand that I may be introduced to, fitted with, observe, or use wearable mobility technology, exoskeletons, powered footwear, e-bikes, accessories, tools, or related equipment. The activity may include standing, walking, accelerating, stopping, turning, bending, lifting, reaching, climbing, using stairs or slopes, traveling over varied surfaces, performing simulated or actual work tasks, or participating near equipment, vehicles, machinery, members of the public, or environmental hazards.

2. Non-medical program

I understand that Radventurers does not provide medical care, diagnosis, rehabilitation, physical therapy, occupational therapy, medical-device prescription, or clinical clearance. Product demonstrations and observations are educational and commercial. Statements about comfort, effort, movement, performance, or personal experiences are not medical advice or proof of a health benefit.

3. Participant representations

I represent that I have truthfully disclosed any condition, symptom, injury, recent surgery, medication effect, pregnancy, balance limitation, fainting history, seizure history, cardiovascular concern, neurological concern, musculoskeletal concern, skin sensitivity, or other issue that could affect safe participation. I am not impaired by alcohol, cannabis, drugs, fatigue, or medication. I am physically and mentally able to understand instructions and stop when directed.

4. Risks

I understand that risks include, without limitation: falls; trips; collisions; loss of balance; sudden or unexpected device movement; pinching; pressure points; chafing; skin irritation; muscle soreness; fatigue; overexertion; strains; sprains; fractures; head, neck, back, joint, nerve, or soft-tissue injury; aggravation of a known or unknown condition; battery, electrical, charging, heat, software, sensor, strap, fastener, wheel, brake, motor, or mechanical malfunction; interaction with terrain, stairs, slopes, traffic, machinery, PPE, clothing, footwear, tools, weather, water, heat, cold, or other people; property damage; and, in rare circumstances, permanent disability or death.

5. Assumption of risk

I voluntarily choose to participate and knowingly assume all inherent and other risks of the activity, whether known or unknown, foreseeable or unforeseeable, except to the extent a risk cannot lawfully be assumed.

6. Release and covenant not to sue

To the fullest extent permitted by applicable law, I release and agree not to sue the Released Parties for claims, demands, losses, damages, liabilities, costs, or causes of action arising from my participation, use of equipment, presence at the activity, or emergency response, including claims based on ordinary negligence. This release does not apply to conduct that cannot legally be released, including gross negligence, reckless or intentional misconduct where prohibited.

7. Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from third-party claims, property damage, losses, or expenses arising from my violation of instructions, misuse of equipment, unauthorized activity, false or incomplete disclosures, or conduct that harms another person or property.

8. Equipment responsibility

I will use equipment only as instructed; will not alter, disassemble, bypass safeguards, lend, transfer, or use it outside the authorized area or activity; and will immediately report damage, abnormal behavior, impact, contamination, or loss. I accept financial responsibility for loss or damage caused by intentional misconduct, unauthorized use, theft, or failure to follow instructions, ordinary wear excepted.

9. Safety authority and stop conditions

Radventurers may refuse, restrict, modify, postpone, or stop participation at any time. I will stop immediately for pain, numbness, dizziness, shortness of breath, chest discomfort, instability, unusual fatigue, overheating, skin injury, device error, equipment damage, unsafe conditions, or staff direction.

10. Emergency care

If I cannot provide consent, I authorize reasonable emergency assistance and contact with emergency services. I understand that Radventurers does not guarantee medical personnel will be present. I am responsible for medical, ambulance, transport, or related costs to the extent permitted by law.

11. Personal property

I am responsible for my personal property. Released Parties are not responsible for loss, theft, or damage except as required by law.

12. No warranty of result

No specific result, level of assistance, comfort, speed, endurance, workplace benefit, purchase suitability, or injury prevention is promised. Product performance varies by user, fit, settings, environment, maintenance, and task.

13. Governing law; venue; severability

Unless prohibited by applicable law or superseded by a separate written agreement, this agreement is governed by Colorado law, and any dispute shall be brought in a court of competent jurisdiction serving Douglas County, Colorado. If any provision is unenforceable, the remaining provisions remain effective to the fullest extent allowed.

14. Entire agreement and understanding

I have had the opportunity to ask questions, read this agreement carefully, and consult legal or medical advisers. I understand that I am giving up substantial legal rights. No oral statement changes this agreement.

Parent or guardian consent for a minor

I am the parent or legal guardian of the minor participant. I consent to participation, make the representations above on behalf of the minor to the extent legally permitted, and agree to the provisions applicable to me. Counsel should review enforceability for minors before use.
